Terms of Service (Arcade Everywhere)

These Terms of Service (“Terms”) govern the booking and delivery of services provided by Arcade Everywhere (“AE,” “we,” “us,” “our”). By booking, paying a deposit, or accepting a quote/invoice from AE, you (“Client,” “you,” “your”) agree to these Terms.

1) Services Covered

AE provides mobile entertainment rentals and event services, which may include:

  • Delivery and pickup of games/equipment

  • Setup and takedown (when included)

  • Optional on-site facilitation/attendant (“Game Guide”)

  • Event-based gameplay support, instructions, and coordination

Your specific services, equipment, timing, and pricing will be detailed in your quote, invoice, or booking confirmation (“Booking Details”). If Booking Details conflict with these Terms, the Booking Details control.

2) Quotes, Booking, and Reservation

A date/time is not reserved until AE confirms your booking in writing and receives any required deposit.

AE may decline a booking for reasons including (but not limited to): unsafe site conditions, insufficient access, inaccurate information, scheduling conflicts, or behavior that puts people or equipment at risk.

3) Deposits, Payments, and Taxes

  • Deposit: AE may require a deposit to reserve your date. Deposits are applied to your total unless otherwise stated.

  • Final Payment: Remaining balance is due by the deadline in your invoice/confirmation (commonly prior to delivery/setup).

  • Late Payment: Late payments may result in cancellation of the booking and forfeiture of deposit (where permitted).

  • Taxes/Fees: Any applicable sales tax, processing fees, venue fees, permits, or special access costs are the Client’s responsibility unless explicitly included.

4) Changes to Your Booking

If you need to change date, time, location, package, or major details, notify AE as soon as possible. Changes are subject to availability and may affect pricing, staffing, and logistics.

AE will make reasonable efforts to accommodate changes, but cannot guarantee availability for last-minute adjustments.

5) Client Responsibilities and Event Site Requirements

You agree to provide a safe, workable environment for delivery, setup, and use of equipment.

A. Site access

You are responsible for ensuring:

  • Clear access for delivery and setup during the scheduled window

  • Legal access to the venue/property (including venue approvals)

  • Reasonable proximity to setup area (or disclosure of distance/obstacles)

If AE arrives and cannot access the site due to Client/venue issues, the booking may be treated as a same-day cancellation (see Section 10).

B. Space and surface

You are responsible for providing suitable space and surfaces for the selected package (indoor/outdoor). AE can advise layouts, but final site suitability is the Client’s responsibility.

C. Power and lighting (if applicable)

If any rented items require power (or if you request powered add-ons), you must provide safe, code-compliant power access unless AE agrees otherwise in writing.

6) Supervision and Safety

AE’s games are physical and interactive. Safety requires common sense.

  • Adult Supervision: Client is fully responsible for supervising participants at all times, including minors. AE is not responsible for participant supervision, behavior, or safety, even if AE provides a Game Guide/attendant.

  • Safe Use: Participants must follow AE’s instructions and any posted rules.

  • Right to Pause/Stop: AE may pause or end use of any equipment if unsafe behavior occurs or conditions become hazardous (weather, crowding, intoxication, venue restrictions, etc.). In such cases, refunds and credits are not guaranteed.

7) Game Guide / Attendant Services

If your package includes a Game Guide:

  • AE will provide general facilitation, instructions, basic crowd flow, and game support.

  • The Game Guide is not a substitute for parental/guardian supervision and is not a security service.

  • The Client remains responsible for overall event safety and participant conduct.

8) Delivery, Setup, and Takedown

  • Delivery/setup windows will be provided in your Booking Details.

  • The Client must ensure access is available at the scheduled time.

  • Setup areas must be reasonably clean, level, and safe.

  • AE may adjust placement/layout if needed for safety or fit.

If setup/takedown is not included in your package, AE will provide basic instructions and you agree to follow them.

9) Service Area and Travel Fees

AE is based in Chattanooga, TN 37412. Travel fees and/or minimum booking amounts may apply based on distance, drive time, package size, and staffing.

Unless your Booking Details specify otherwise:

  • Your quote may include a travel fee

  • Longer-distance bookings may require a minimum package level

  • Toll fees, paid parking, special loading requirements, or venue fees may be passed through to the Client

10) Cancellation, Reschedule, and Weather

Specific cancellation terms may be listed in your Booking Details. If not, the following apply:

A. Client cancellation

  • More than 14 days before event: deposit may be refundable or creditable at AE’s discretion (minus any non-recoverable costs).

  • 7–14 days before event: deposit is 50% refundable. Alternatively, you may choose a reschedule credit at 100% of the amount paid (subject to availability).

  • Less than 7 days before event: non-refundable, but credit may be offered at AE’s discretion (subject to availability).

  • Same-day cancellation or denial of access: non-refundable. Any credit is at AE’s discretion.

B. Credits and expiration

If AE issues a credit (including reschedule credit), credits are valid for up to six (6) months from the date of the canceled event, unless otherwise stated in writing. Credits have no cash value and may be applied only to AE services, subject to availability.

C. Rescheduling

AE will make reasonable efforts to reschedule once without penalty if sufficient notice is given. Reschedules are subject to availability and may include price differences due to season, staffing, or distance.

D. Weather policy (outdoor events)

Weather is a fact of life. If your event is outdoors:

  • Light rain/wind may not qualify for cancellation

  • Unsafe conditions (lightning, severe storms, high winds, flooding, etc.) may require delay, modification, or cancellation

  • If feasible, AE may offer indoor relocation or alternative setups

  • Refunds for weather are not guaranteed unless your Booking Details state otherwise

11) Equipment Care, Damage, Loss, and Cleaning

You are responsible for equipment from the time it is delivered (or made available) until it is picked up and inspected.

You agree to:

  • Use equipment as intended and follow instructions

  • Prevent misuse, vandalism, or theft

  • Keep equipment away from fire, extreme heat, and hazardous materials

  • Keep food/drink off equipment unless explicitly allowed

  • Return all components (balls, putters, pieces, accessories)

Damage/Loss Fees

The Client is responsible for repair or replacement costs for:

  • Broken components

  • Missing items

  • Excessive wear from misuse

  • Water damage beyond normal outdoor exposure

  • Damage caused by participants, pets, venue staff, or third parties

AE may charge the payment method on file or invoice the Client for replacement/repair costs.

Cleaning Fees

If equipment is returned excessively dirty (mud-caked, sticky spills, paint, glitter, etc.), cleaning fees may apply.

12) Photography and Video

AE may take photos/video at events for marketing purposes only when permitted (for example, with host approval, venue policy compliance, and reasonable efforts to respect participants).

If you do not want AE to capture or use event media, you must notify AE in writing prior to the event.

13) Force Majeure

AE is not liable for delays or failure to perform due to events outside reasonable control, including severe weather, natural disasters, road closures, government actions, power outages, venue shutdowns, or emergencies.

If a force majeure event occurs, AE may offer rescheduling or credit where feasible.

14) Disputes, Chargebacks, and Legal

  • Good-faith resolution first: Contact AE at contact@arcadeeverywhere.com and we’ll try to resolve issues quickly.

  • Chargebacks: Initiating a chargeback without first contacting AE to resolve the issue may be treated as a breach of these Terms.

  • Governing Law: Tennessee law applies.

  • Venue: Disputes will be brought in state or federal courts located in Hamilton County, Tennessee, unless AE agrees otherwise in writing.

15) Limitation of Liability

To the fullest extent permitted by law:

  • AE is not liable for indirect, incidental, special, consequential, or punitive damages arising from services or equipment use.

  • AE’s total liability related to any booking will not exceed the amount paid to AE for that booking.

Nothing in these Terms limits liability where it cannot legally be limited.

16) Updates to These Terms

AE may update these Terms from time to time. The version in effect on the date your booking is confirmed will apply unless otherwise stated in writing.
